NEW CHALLENGES TO THE SETTLEMENT OF OLLECTIVE LABOR DISPUTES
Abstract
Collective labor disputes were first legally regulated in our country with the Law on the Settlement of Collective Labor Disputes in 1990. The historical merit of this law lies in its concept that the dispute should be “settled”, not “resolved”. “Settlement” is understood as reaching an agreement between the disputing parties, and “resolution” is the provision of a mandatory response to the disputed issues by a judicial or other body. Against the backdrop of some social unrest and the sharp reactions to them in recent months, the regulation of the Law on the Settlement of Collective Labor Disputes has once again attracted public attention. The purpose of the study is to substantiate that any “civil disobedience”, blockades, etc. have nothing to do with the strike as a legally regulated method for protecting the collective interests of employees. Against the background of the "pathology" in the application of the law, it is appropriate to re-analyze the current legal framework and what its implementation should be in order to protect the legal rights and interests of all parties affected by the collective labor dispute..
