JUXTAPOSITION BETWEEN THE NORMATIVE AND THE FACTUAL IN LAW

Abstract

The application of the law is unthinkable without the subsumation of the facts relevant to the case, compared to the provisions of the legislator in the hypothesis of the applicable legal norm. The syllogism as a logical basis of the application is built by interpreting the norm and arguing the conformity of the facts with it. Arguing compliance is based on the process of legal reasoning. When comparing the facts with the norm from a theoretical point of view, several options are possible. Тhe purpose of this report is to extract and analyze them.
