DISCUSSION QUESTIONS REGARDING THE TRANSFORMATION OF THE CARE OBLIGATION IN THE MAINTENANCE AND CARE CONTRACT

Abstract

The maintenance and care contract against the transfer of ownership of real estate is widely used in practice, although its implementation often gives rise to legal disputes. This is evidenced by the large number of legal proceedings, which are considered annually by the courts, regarding non-fulfillment of the obligations of the parties under this contract. The report presents the various opinions advocated in the practice of the Supreme Court regarding the transformation of the in-kind obligation to look after the contract into a monetary one. The author argues his views on the discussion questions.
