SIX-MONTH CONTINUOUS POSSESSIO AS A CONDITION FOR FILING A CLAIM UNDER ART. 75 OF THE PROPERTY ACT
Abstract
Sovereign claims are designed to protect factual states from arbitrariness and self-government, and on the other hand, they are a supplement to the petitioner's defense. According to Art. 75 of the Law on Property, the claimant must prove that he has continuously possessed the property for more than six months in order to have the active legitimation for the claim for disturbed possession. This report examines the cases where the above-mentioned condition creates difficulties in conducting the ownership protection under Art. 75 of the Law on Property.
